2. Scope
2.1. These terms apply to the use of the nestnod.com website and the Nestnod mobile app (together: the Service) between the Provider and the person using the Service (User).
2.2. The website currently presents the Service and offers a waitlist. Provisions relating to the app apply from the app’s release.
2.3. By using the Service or registering in the app, the User accepts these terms. The contract is concluded electronically, is not filed by the Provider, and the current terms are always available on this page.
3. What Nestnod is – and isn’t
3.1. Nestnod is a family safety app: users can look out for each other (a “circle”). The app records signs of life (such as the phone’s step counter, opening the app, the “I’m okay” button, confirming a medication) and, if none arrives by the time set, first asks the person, then notifies their watchers in the chosen order. Further features: “I need help” button, safe arrival timer, medical info, medication reminders, signs (❤️), simple mode, pause, daily summary, insights (unusual quiet, moving less), heat and cold alerts, monthly report, family log, key-holder neighbor, daily call, and Nesti, an AI daily companion. Insights and weather alerts are for information only and are not medical or official weather warnings.
3.2. Nestnod is not an emergency service, not a medical device, and does not replace medical care or the authorities. It notifies family members, not ambulance, police or fire services. In an emergency, always call your local emergency number (112 in the EU).
3.3. Delivery of notifications depends on third-party services (Apple and Google notification systems, mobile networks, the internet) and on device settings (notifications allowed, Do Not Disturb, battery saving, a dead or switched-off phone). The Provider does its best for reliable operation but does not guarantee that every notification is always delivered immediately or that every sign of life is always recorded.
4. Registration and account
4.1. Using the app requires signing in with an email address. The Service may be used independently from the age of 16; under 16 only with the consent of a parent or legal guardian.
4.2. The User is responsible for the accuracy of the data they provide (name, phone number, medical info, alert order) and for keeping access to their account to themselves.
4.3. A watching relationship can only be created with an invite code and the participation of both people, and either can end it at any time. Users may only look out for someone with that person’s knowledge and consent; the Service must not be used for secret surveillance.
4.4. Users can delete their account in the app at any time; their personal data is then deleted as described in the privacy notice.
5. Fees and subscriptions
5.1. The app’s core features are free. Nestnod Plus adds further features (unlimited family members, insights, heat and cold alerts, monthly report, family log, safe arrival timer, medication reminders, daily summary, weekly family picture). Alert+ (SMS and a phone call during an alert) is a separately purchasable add-on. Current prices and features are shown in the app before purchase; prices on the website are indicative.
5.1a. Nestnod Pro covers one protected person chosen by the subscriber: a daily call (landlines too), Nesti daily chats up to 45 minutes a month, and the Alert+ add-on. Unused minutes don’t carry over; if the allowance runs out, Nesti pauses until the next month while the daily call and alerts keep working. Pro also gives the subscriber’s circle the Plus features.
5.2. Purchases and payment go through the Apple App Store or Google Play under their terms. Subscriptions renew automatically at the end of each period (month or year) until cancelled in the store’s account settings, at least 24 hours before renewal. After a free trial the subscription becomes paid unless cancelled before the trial ends.
5.3. Family plan: Plus also covers the members of the subscriber’s circle (people they have a watching relationship with) while the relationship and the subscription last.
5.4. Price changes are announced in advance under the store’s rules; the price of an already paid period does not change.
5.5. Right of withdrawal: consumers have a 14-day right of withdrawal under applicable law. At the User’s express request, performance of the digital service starts immediately upon purchase; refunds are handled by the App Store or Google Play under their own procedures. Mandatory consumer rights remain unaffected.
5A. Nesti – chatting with an AI
5A.1. Nesti is an artificial intelligence (a computer companion), not a person, and says so at the start of every call. Speech is converted to text by speech recognition, replies are generated by a language model (Anthropic Claude), and calls are carried by Twilio. Nesti can make mistakes or misunderstand, and gives no medical advice.
5A.2. Nesti only works with the consent of the person being called. If that person doesn’t use a smartphone and a family member records their consent in the app, the family member confirms that the person was informed and agreed. The person can stop the calls at any time (just by saying so during a call), and the family can switch them off.
5A.3. Family members only receive a short automatic summary of each chat (mood, notable mentions, any warning sign), never the conversation itself. The text is deleted after 30 days. If the person describes an emergency, Nesti alerts the family and the key-holder neighbor right away; this does not replace calling the emergency number.
5B. Key-holder neighbor and family members without a smartphone
5B.1. Only someone who has agreed in advance may be added as a key-holder neighbor; the User is responsible for this. The neighbor gets an introductory text when added and can ask to be removed at any time. During an alert they receive a link valid for 24 hours showing the person’s name, address, access information, medical info and the family’s phone numbers. Only enter information in the medical info and access fields that you would want shared with the neighbor in such a situation.
5B.2. A family member without a smartphone (with daily calls) may only be added with their knowledge and consent. The family member who adds them manages their settings and is responsible for the accuracy of the data.
6. User obligations
Users may not use the Service unlawfully, to harass or deceive others, to deliberately trigger false alerts, to disrupt or reverse-engineer the system, or to gain unauthorised access. In case of breach, the Provider may suspend or close the account.
7. Liability
7.1. The Provider delivers the Service with the care that can be expected of it but, for the reasons in 3.2 and 3.3, is not liable for damage resulting from a notification not arriving or arriving late, or a sign of life not being recorded, where the cause is outside the Provider’s control (such as network failure, device settings, or an outage of a third-party service).
7.2. The Provider is not liable for damage resulting from incorrect data entered by the User (such as medical info or phone numbers).
7.3. These limitations do not apply to liability for intentional or grossly negligent breach, or for breach causing harm to life, physical integrity or health (Section 6:152 of the Hungarian Civil Code), and do not affect consumers’ statutory rights.
7.4. The Service is continuously developed and may be temporarily unavailable for maintenance or due to faults; planned maintenance is announced in advance where possible.
8. Intellectual property
The content and design of the website and the app, and the “Nestnod” name and logo, are the Provider’s intellectual property and may not be copied, distributed or modified beyond normal use of the Service without permission.

10. Complaints and redress
10.1. Send complaints to info@nestnod.com or by post to the registered address. Written complaints are examined and answered in writing within 30 days. Refund requests for in-app purchases can also be made to the relevant store.
10.2. If your complaint is rejected, as a consumer you may turn to the conciliation body competent for your place of residence (Hungary: bekeltetes.hu) or to the courts.
11. Changes
The Provider may amend these terms and will announce material changes at least 15 days before they take effect, in the app or by email. Users who do not accept a change may delete their account; continued use counts as acceptance.
12. Governing law
Hungarian law applies, without limiting the mandatory consumer protection of the User’s country of residence.
